These Terms and Conditions explain the rules that apply when you use the BindrTCG mobile application.

BindrTCG is owned and operated by an individual developer. In these Terms, “BindrTCG,” “we,” “us,” and “our” refer to the developer of the BindrTCG app.

By using BindrTCG, you agree to these Terms. If you do not agree, you should not use the app. If you have questions, contact us at bindrtcg@gmail.com.

1. About BindrTCG

BindrTCG is a virtual trading card binder app. It allows users to create digital binders, customize binder pages, add cards or images to grid layouts, upload binder covers and page backgrounds, and share binder page images outside the app.

BindrTCG is intended for personal, non-commercial use unless we separately give written permission for another use.

2. Eligibility and Accounts

You may use BindrTCG as a guest or by syncing your account using Apple Sign-In or Google Sign-In.

When you use Apple or Google login, we may receive an email address from the login provider. We use this email address to show which account you are logged into, help identify your account, support account syncing, and assist with account-related support or deletion requests.

You are responsible for keeping access to your device, Apple account, Google account, and BindrTCG account secure.

If you use BindrTCG on behalf of a child or allow a child to use the app, you are responsible for supervising their use of the app, including uploads, sharing, purchases, and account syncing.

3. Guest Accounts and Account Syncing

BindrTCG may allow guest usage. Guest accounts are linked to a unique account identifier and may have limited recovery options if the app is deleted, the device is reset, or account data is lost.

You may be able to sync a guest account with Apple Sign-In or Google Sign-In to help preserve and access your data. You are responsible for making sure you sync the correct guest account with the correct Apple or Google account.

4. User Content

You may create, upload, save, customize, or share content in BindrTCG, including binder names, binder designs, binder page layouts, cover images, grid slot images, page background images, and shared binder page images.

You are responsible for the content you upload or create. You agree that you will not upload, create, or share content that:

• You do not have the right to use
• Infringes intellectual property, privacy, publicity, or other rights
• Contains illegal, harmful, abusive, hateful, threatening, or exploitative material
• Contains malware, malicious code, or attempts to interfere with the app
• Violates applicable laws, platform rules, or these Terms

You retain ownership of content you upload, subject to any rights owned by third parties. By uploading content to BindrTCG, you give us permission to store, process, display, back up, and transmit that content only as needed to provide and operate the app.

5. Uploaded Images and Sharing

Uploaded images are intended to remain private to your account unless you choose to share content outside the app.

If you use a sharing feature, BindrTCG may generate an image or screenshot of a binder page. The shared image may include your uploaded images, card images, backgrounds, layouts, and other visible page content.

Once you share content outside BindrTCG, we cannot control how other apps, services, recipients, or platforms use, store, copy, or redistribute that content.

6. Card Data and Third-Party Content

BindrTCG may display trading card data and card images from third-party card data providers, including TCGDex.

Card names, card images, trademarks, logos, and related intellectual property belong to their respective owners. BindrTCG does not claim ownership of third-party trading card intellectual property.

BindrTCG is an independent app and is not affiliated with, endorsed by, sponsored by, or officially connected with The Pokémon Company, Nintendo, Game Freak, Creatures Inc., or any other trading card rights holder unless explicitly stated.

Third-party card data may be incomplete, unavailable, changed, removed, delayed, or inaccurate. We do not guarantee that card data, card images, names, or other third-party content will always be available or error-free.

7. Subscriptions and Paid Features

BindrTCG may offer free features and paid subscription features. Subscription availability, pricing, trial availability, renewal terms, and included features may vary by platform, country, or store.

Payments are handled by Apple App Store or Google Play, depending on your device. We do not process or store your payment card information.

Subscriptions may renew automatically unless canceled according to the rules of the store where you purchased the subscription. You are responsible for managing and canceling subscriptions through your Apple App Store or Google Play account settings.

Deleting your BindrTCG account or uninstalling the app may not automatically cancel an active subscription. You must cancel the subscription through Apple App Store or Google Play if you no longer want to be charged.

Refunds, cancellations, billing issues, and renewal disputes are generally handled by Apple or Google according to their respective policies.

8. Acceptable Use

You agree not to:

• Use BindrTCG for illegal, harmful, abusive, or infringing purposes
• Attempt to access, modify, or delete another user’s data
• Reverse engineer, copy, scrape, or misuse the app or its backend services except where allowed by law
• Interfere with the security, availability, or performance of the app
• Upload or share malicious files, code, or content
• Use automated systems to abuse the app, APIs, or storage systems
• Misrepresent your relationship with BindrTCG or any trading card rights holder

9. Intellectual Property

BindrTCG, including its app design, branding, interface, features, logo, and original materials, is owned by the developer of BindrTCG, except for third-party content and intellectual property owned by others.

You may not copy, modify, distribute, sell, lease, sublicense, or exploit BindrTCG or its original materials except as allowed by these Terms or with our written permission.

10. Privacy

Your use of BindrTCG is also governed by our Privacy Policy. The Privacy Policy explains what information we collect, why we collect it, how we use it, and how account deletion works.

Please review the Privacy Policy before using the app.

11. Account Deletion and Termination

You may delete your BindrTCG account from inside the app. When you delete your account, we delete data associated with your account, subject to technical, legal, security, backup, and deletion-queue limitations explained in the Privacy Policy.

We may suspend, restrict, or terminate access to BindrTCG if we believe you have violated these Terms, misused the app, created legal risk, infringed third-party rights, or threatened the security or operation of the app.

12. App Availability and Changes

We may update, change, suspend, limit, or discontinue any part of BindrTCG at any time. Features may change over time, including free limits, paid features, sharing options, card data integrations, and customization options.

We do not guarantee that the app will always be available, uninterrupted, secure, or error-free.

13. Disclaimers

BindrTCG is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement.

We do not guarantee that user content, card data, uploaded images, shared images, subscriptions, or app features will always be available, backed up, recoverable, uninterrupted, or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, BindrTCG and its developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, content, profits, revenue, goodwill, or business opportunities arising from or related to your use of the app.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

15. Third-Party Services

BindrTCG may rely on third-party services, including Apple, Google, Firebase, Google Cloud, TCGDex, app store billing systems, and authentication providers.

Your use of third-party services may be subject to their own terms, policies, and privacy practices. We are not responsible for third-party services, content, outages, policies, or actions.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify users by updating the “Last updated” date, showing an in-app notice, or using another appropriate method.

Your continued use of BindrTCG after changes are posted means you accept the updated Terms.
